The U.S. Department of Agriculture has issued certificates of
protection to developers of 16 new varieties of seed-reproduced
and tuber-propagated plants. They include bean, bluegrass,
fescue, orchardgrass, pea, pepper, soybean, watermelon, and
wheat.
The certificates are being issued under the Plant Variety
Protection Act. The certificates require that the varieties be
new, distinct, uniform and stable. The owners will have the
exclusive right to reproduce, sell, import and export their
products in the United States for the duration of protection.
The 16 certificates are:
- the Green Valley variety
of garden bean, developed by Seminis Vegetable Seeds,
Inc., Oxnard, Calif.;
- the EverGlade variety of
Kentucky bluegrass, developed by J.R. Simplot
Company, Post Falls, Idaho;
- the Rampart variety of
Kentucky bluegrass, developed by TurfOne, Albany, OR, &
Rutgers, The State University of New Jersey, New Brunswick,
N.J.;
- the Grasslands Flecha*
variety of tall fescue, developed by Grasslanz
Technology Limited, Palmerston North, New Zealand;
- the LG31 variety of
orchardgrass, developed by Cascade International Seed
Co., Aumsville, Ore.;
- the XP 08550820 and
Reliance varieties of pea, developed by Seminis
Vegetable Seeds, Inc., Oxnard, Calif.;
- the SBR991260, SBR991295,
SBY991296 varieties of pepper, developed by Seminis
Vegetable Seeds, Inc., Oxnard, Calif.;
- the 94Y10 and RJS18002
varieties of soybean, developed by Pioneer Hi-Bred
International, Inc., Johnston, Iowa;
- the 90-4262 variety of
watermelon, developed by Syngenta Seeds, Inc., Boise,
Idaho;
- the Oglethorpe variety of
common wheat, developed by the University of Georgia
Research Foundation, Inc., Athens, Ga.;
- the Crystal* variety of
common wheat, developed by Michigan State University,
Lansing, Mich.; and
- the Jensen* variety of
common wheat, developed by Cornell University, Ithaca,
N.Y.
* In the United States, seed of
this variety shall be sold by variety name only as a class of
certified seed, and shall conform to the number of generations
specified by the owner of the rights (84 STAT. 1542, as amended,
7 U.S.C. 2321 ET SEQ).
USDA’s Agricultural Marketing Service administers the Plant
Variety Protection Act, which provides time-limited marketing
protection to developers of new and distinct seed-reproduced and
tuber-propagated plants ranging from farm crops to flowers.
