Obtaining plant variety rights in South Korea

Seoul, Republic of Korea
November 2020

As a member state of the UPOV convention, South Korea actively protects new plant varieties.

There are no restrictions on the type of plant varieties protectable. Therefore, food crops, vegetables, flowers, forage crops, cash crops, fruit trees, and aquatic plants may be protected in Korea.

Hanol IP & Law is a leading intellectual property law firm in South Korea with more than 20 patent attorneys and a product development team, helping foreign plant breeders file plant variety protection rights, license the varieties, and enforce their rights in Korea.
