In a court case brought by
Bayer CropScience,
three counterfeiters of crop protection products have been found
guilty by the criminal court in the Spanish city of Murcia. They
had been selling various products that were not licensed in
Spain and were not properly labeled. The court stressed that the
possible health risks associated with such illegal use had been
a major factor in reaching the verdict. The defendants were
sentenced to a fine on grounds of an offense against public
health and consumer protection. In addition, they are
temporarily banned from trading in the crop protection industry.
This verdict shows how important for consumer health it is that
crop protection products are manufactured properly and used
appropriately.
Some of the products marketed by the defendants in Spain
contained the active substance imidacloprid, consequently
infringing the patent at that time held by Bayer CropScience.
The legal proceedings were instituted in 2004 in a close joint
effort by Bayer CropScience and the relevant authorities.

Bayer CropScience vor Gericht erfolgreich: Fälscher von
Pflanzenschutzmitteln wegen Gesundheitsgefährdung verurteilt
In einem von Bayer CropScience angestrengten Prozess hat der
Strafgerichtshof von Murcia, Spanien, drei Fälscher von
Pflanzenschutzmitteln schuldig gesprochen. Sie hatten
verschiedene in Spanien nicht zugelassene und nicht
vorschriftsmäßig gekennzeichnete Produkte vertrieben. Das
Gericht machte deutlich, dass die vom illegalen Einsatz
ausgehenden möglichen Gesundheitsgefahren bei der Urteilsfindung
eine große Rolle gespielt hätten. Die Angeklagten wurden wegen
Vergehen gegen die öffentliche Gesundheit und gegen den
Verbraucherschutz zu einer Geldstrafe verurteilt. Darüber hinaus
dürfen sie zeitweise nicht mehr gewerblich im
Pflanzenschutzmittelbereich tätig sein. Dieses Gerichtsurteil
macht deutlich, welche Bedeutung die sachgerechte Herstellung
und bestimmungsgemäße Anwendung von Pflanzenschutzmitteln für
die Gesundheit der Verbraucher hat.
Einige der in Spanien vermarkteten Produkte enthielten den
Wirkstoff Imidacloprid, dessen damaliges Patent von Bayer
CropScience von den Angeklagten damit verletzt wurde. Die Klage
wurde im Jahr 2004 in enger Zusammenarbeit von Bayer CropScience
und den zuständigen Behörden erhoben. |
