LP jointly announced today that they have reached a
settlement in a lawsuit filed by Bayer for alleged infringement
on its U.S. Patent No. 5,783,203 for the pesticide Imidacloprid
on fertilizer.
Nufarm fully respects intellectual property rights and
acknowledges the validity of the patent, as issued by the US
Patents & Trademarks Office. Under the terms of the settlement,
Nufarm and its Customers have full freedom to operate (with
immediate effect) with this patented Imidacloprid on fertilizer
technology; including the ability to commercialize Mallet™
incorporating the patented technology onto any fertilizer type.
Both parties to the suit have withdrawn all claims and
counterclaims in this matter. Other terms of the settlement will
remain confidential.
Nufarm reaffirms its continued commitment to strongly support
its customers and sales of Mallet™ 0.2% on Fertilizer to the
market.
