How are the countries of the Asia Pacific region dealing with the issue of intellectual property?
 
While some countries such as Australia, China, Japan, New Zealand and the Republic of Korea are members of UPOV, countries such as Thailand and India have enacted appropriate sui-generis laws on PVP.

A seed company engaged in business in a number of countries will undoubtedly benefit from the PVP system of UPOV. This is, however, of no consequence to national seed companies.

Other countries are in the process of developing appropriate systems for addressing the issue of intellectual property rights.

Countries that are not members of UPOV but which have enacted PVP laws that are yet to be enforced include India, the Philippines, Thailand and Vietnam. There is an ongoing process for enacting an appropriate sui generis law on PVP in Bangladesh, Malaysia, Pakistan and Sri Lanka. Other countries have yet to produce a draft PVP law or join UPOV.
