The Vietnamese goverment has issued decree No 104/2006/ND-CP, which has detail provisions, executing guidances for some articles of intellectual property rights Law to plants varieties. Under this decree, protected plant variety including: complete plants varieties, breeding materials, haversting materials of plant varieties from agriculture, forestry, water grow plants, new selected fungi.

Register application to plant variety shall be stipulated under section 2, Article 164 of IPRs Law.

National Protection Agency shall has responsible to estabish and save national registration number of protected plant variety. Protected inventors or plants breeders shall have the rights as stipulated under IPRs Law.

The decree is also allow the IP owners have the rights to transfer, selling or offering to sell theirs rights of protected plant variety.

The decree shall be effective after 15 days from the publishing on National Gazette.
